K-1 Packaging Group LLC, a California limited liability company, (“We” or “K-1”) respects the privacy of its customers and their agents (its “Customers”), as well as individuals that visit its website. For avoidance of doubt, K-1 serves businesses as its Customers; it generally does not seek business from individual consumers. Accordingly, while this Privacy Policy discusses consumer rights and information, it should not be construed as an invitation or solicitation of information and business from individual consumers.

Our Website and services are operated in the United States, but can be accessed worldwide.

  • When you interact with our advertising, applications on third-party websites, and other methods of communication and interaction, if the advertising, applications, or communications include reference or links to this Privacy Policy.

  • Other means outside of our specific direction and control, including on any other website operated by any third party; or
  • Any third party, including through any application or content (including advertising) that links to or is accessible from or through the Website.

Children Under the Age of 18 Not Permitted; Other Categories of Declined Information.

Our Website is not intended for children under 18 years of age. No one under age 18 is permitted to provide any information to K-1, whether on the Website, via email or other messaging, or through contact with an agent or representative of K-1 offline. We do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information on this Website or on or through any of its features, or provide personal information to K-1 via email, responses to advertising communications, or via any other methods. Similarly, we do not request, accept, or collect any of the following: (i) Any data revealing racial or ethnic origins or background, religious beliefs, mental or physical health conditions or diagnoses, sexual activity or orientation, status as transgender or non- binary, status as a victim of crime, citizenship, or immigration status; (ii) Genetic or biometric data processed to uniquely identify an individual; (iii) precise present or past geolocation data, or the present or past location of a device that links or is linkable to a consumer (iv) social security number, driver’s license number, passport number, or other government identifier or license; (v) union membership, (vi) or mail, email or text message content unless we are the intended recipient of the communication (collectively “Declined Information”).

 

If we learn we have collected or received personal information from a child under 18 without verification of parental consent, or Declined Information, we will delete that information, and cancel or terminate any services or order transactions in process. We collect several types/categories of Personal Information from and about users of our Website. Information We Collect About You and How We Collect It

 

We collect (and in the preceding 12 months, have collected) the following (“Personal Information”):

  • Identifiers such as a real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, or account name, or any other identifier by which you may be contacted online or offline.
  • Commercial information, including records of K-1 products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
  • Internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding interactions with K-1’s Website, or advertisements (whether on or off K-1’s Website).
  • Inferences drawn from any other category of Personal Information identified above, to create a profile about our Customers’ preferences as to K-1 products.
  • Communications with K-1 Customer Service representatives.

 

We may also collect, as it relates to purchase orders that we process, the following (“Sensitive Personal Information”):

  • Credit card payment information for processing orders, or account information with third party payment platforms.
  • Account log-in, password, or credentials allowing access to an account, for your relationship with us, and provide you with the products and services with which you expect (as well as to help detect security incidents and protect against fraudulent activity).
  • Information provided to K-1 Customer Service representatives over the telephone, via email, or via mail.

 

We also collect (“Non-Personally Identifiable Information”) that is “Deidentified” (information about you but that does not identify you) or “Aggregated” (information about groups of users without a way to reasonably link the information to any individual consumer or household identity, including via a device). We commit to maintain and use Non-Personally Identifiable Information in its original “Deidentified” or “Aggregated” form, and not attempt to reidentify the information.

 

We collect this information:

  • Directly from you when you provide it to us.
  • Automatically as you navigate through the site after accepting our Cookie disclosure. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.
  • From third parties, for example: our advertising vendors, our security vendors who monitor activity for fraud, abuse of our terms of service (such as denial of service attacks or attempts to bypass security and privilege restrictions), and our hosting, content delivery network.

 

Purpose for Collection.

We collect Personal Information to:

  • Perform services and provide goods that you have requested and would reasonably expect.
  • Fulfill related transactions and contacts (such as returns, exchanges, requests for product reviews, and customer service follow-up).
  • Respond to your inquiries, and provide customer service prior to, or separate from a purchase (such as questions about our products, our policies, and our order process).
  • Monitor and operate our Website.
  • Prevent, detect, and investigate security incidents compromising Personal Information.
  • Combat and resist malicious, deceptive, fraudulent, or illegal actions directed at K-1 or its customers, and cooperate with law enforcement to prosecute those responsible for such actions.
  • Maintain physical safety at physical locations (such as our office and warehouses).
  • Personalize content on our Website.

 

We only collect Personal Information as reasonably necessary and proportionate to achieve the purposes for which it was collected or processed, or for another disclosed compatible purpose. We do not further process Personal Information in a way that is incompatible with these purposes.

 

We only collect Sensitive Personal Information to provide goods that our Customers have requested and would reasonably expect, together with our service providers. We do not collect Sensitive Personal Information for any other purpose or share with non-contracted third parties.

 

Length of Time for Retention

We retain Personal Information and Sensitive Personal Information for as long as is necessary based on the purpose with which it was given to us or collected, and consistent with applicable law.

 

The criteria used to determine the expected retention period is specific to the type of information. For example, customers of our Website provide Personal Information to create accounts to make purchases, and we presume they will return to make purchases in the future. We retain that Personal Information and Sensitive Personal Information until the earlier of (a) receipt of an account deletion request, (b) a period of inactivity which we reserve the right to determine in our sole discretion, (c) at any point where we, in our sole discretion, have a concern about security, privacy, fraud, abuse, or other acts contrary to our Terms of Service, that affect the given account.

 

Similarly, we retain email address information for our mailing list, until such time as (a) we receive an unsubscribe request pertaining to a specific email address; (b) we no longer offer a mailing list (with no intention of resuming future mailings); or (c) we determine, in our sole discretion, that one or more email accounts were added based on fraud or abuse, or otherwise act contrary to our Terms of Service.

 

Selling or Sharing Personal Information.

We may share Personal Information about name, postal address, email address, telephone numbers, and any other identifier by which you may be contacted online or offline, with our third-party logistics providers, and with our shipping providers.

 

We also share your Personal Information, such as an individual identifier, or other information collected via cookies and similar technologies with analytics service providers, and with Third Party partners that serve ads on our behalf targeted to your interests in our products, based on your activities online or on our Website, or to otherwise  build our audiences (such as certain offerings from Bing Ads and Google, like Google “Customer Match”). These Third Party partners may charge us for advertising, and use these cookies, individual identifiers, and similar technologies in part to both provide us information on the results of their advertising, as well as to track your movement from their websites to our Website. They may also use these cookies and similar technologies for their own marketing in addition to us offering you our products and services through their websites.

 

We are in the business of selling our products and services, and do not share your Personal Information in exchange for money. However, the California legislature (and other jurisdictions) deem “sale” to include any legal consideration—which can be a contract where we receive services like advertising, site diagnostics, or fraud prevention, even when we are also paying for these services.

 

Because we may be deemed to sell or share your Personal Information, you have the right to opt-out of such sale or sharing with Third Parties. Information You Provide to Us Directly.

 

The information we collect on or through our Website may include:

  • Information that you provide by filling in forms on our Website. This includes information provided at the time of registering to use our Website, subscribing to our service, posting material, or requesting further services. We may also ask you for information when you enter a contest or promotion sponsored by us, and when you report a problem with our Website.
  • Records and copies of your correspondence (including email addresses), if you contact us.
  • Details of transactions you carry out through our Website and of the fulfillment of your orders. You may be required to provide financial information before placing an order through our Website.
  • Customers’ responses to surveys that we might ask you to complete for research purposes.

Information We Generate and Collect Through Automatic Data Collection Technologies.

We generate internal identifiers (like a customer ID) and use customer-provided identifiers (like an email address) to track and manage interactions with our Website and communications, as well as offline to collect and manage account information.

 

As visitors navigate through and interact with our Website, we may use automatic data collection technologies (with consent, when required by applicable law) to generate and collect certain information about visitors, equipment, browsing actions, and patterns, including:

  • Details of your visits to our Website, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Website.
  • Identifiers that recognize visitors, Customers, or their devices over time, and across third party partner websites (like browser or device ID’s, IP addresses, cookies, or other forms of persistent identifiers).

 

We use consent tracking companies, such as CookieYes Limited, to help us monitor whether you consent to our use and collection of your personal information, as well as to help us monitor our compliance with certain privacy laws and regulations.

 

We use content delivery networks (“CDN” or “CDN’s”) which are networks of servers distributed across the United States and worldwide, that serve our Website to you, so our Website loads more quickly for your given location and internet connection, as compared with using a single server. Our CDN provider, GoDaddy Media Temple, Inc. d/b/a Sucuri, provides a fast experience by distributing workload, with servers that are closer geographically to you, and/or more directly connected to your internet service provider.

 

To optimize delivery of our Website to you, these CDN providers automatically collect technical information when you connect to our Website, such as your IP address, browser type and settings, device information, access timestamps, URs of referring/exit pages, geographic location information and internet service information, derived from your IP address (or the IP address of your proxy server), which they use to help pick the fastest server for you, to monitor their performance, and to otherwise provide and bill their content delivery service to us. We also use Web Application Firewall (“WAF”) services from GoDaddy Media Temple, Inc. d/b/a Sucuri. Our WAF service monitors and filters malicious activity, to protect our Customers’ ability to access our Website, and to limit the risk and impact from cyber attacks. WAF services use similar information to CDN providers, with additional information about website visits, requests, browser data, and other technical data to predict, identify, and isolate malicious activity and cyber attacks.

 

We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking) with your consent. You can opt-out of behavioral tracking at the Do Not Sell or Share My Personal Information link located at the bottom of our Website and learn more about how we respond to web browser signals and mechanisms that enable consumers to exercise choices in the discussion below.

 

The information we collect automatically may include Personal Information, or we may maintain it or associate it with Personal Information we collect in other ways or receive from third parties. It helps us to improve our Website and to deliver a better and more personalized service, including by enabling us to:

  • Estimate our audience size and usage patterns.
  • Store information about your preferences, allowing us to customize our Website according to your individual interests.
  • Speed up your searches.
  • Recognize you when you return to our Website.

Note that these partners may track your clicks and interests (sometimes called behavior) onto other websites, and on multiple devices. Beacons. Our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit K-1, for example, to count users who have visited a page or opened an email and for other related statistics (for example, recording the popularity of certain content or products, and verifying system and server integrity). In all circumstances, we limit the collection of personal data to what is adequate, relevant, and reasonably necessary, unless you have given us consent otherwise. Information We Collect from Third Parties, and Public Sources

 

We collect Personal Information about you from publicly available sources, third parties (different from a Service Provider, as we explain below), and other contractors, social media platforms, and data aggregators/resellers. Here are examples:

 

Third Party Providers. We may use Personal Information from third parties (“Third Parties”) like Google Advertising (such as Customer Match, and certain audience-building services), that help us grow our audience,  as well as third-party logistics providers, that help us fulfill orders, and security providers that help us identify potential fraud or abuse.  Generally, these Third Party providers help us offer and provide our goods and services to new and existing Customers. However, different from “Service Providers”, Third Parties either do not, or cannot agree to specific limitations on collection and use of our users and Customers’ information, as required by applicable law.

 

Publicly Available Sources. We may use Personal Information available from public databases, usually in the form of identifiers like names, postal addresses, email addresses, telephone numbers. We typically use this information for advertising and fraud detection, in addition to order processing and verification.

 

Social Media Platforms. We may use Personal Information from social media platforms like Facebook and Instagram, particularly when potential customers interact with content by social media platforms about us (like our ads on those platforms) or that relates to businesses like us. We also may obtain Personal Information from those social media platforms to provide a service to you—such as if you were to share a picture, link to a product, or otherwise post content to that platform using a social media link directly on our site. Our receipt and use of that Personal Information is subject to the particular social media platform’s relationship with you, and any opt-out choice or privacy policy that you have indicated to that social media platform, as well as that platform’s requirements for linkages with third parties.

 

Data Aggregators. We may purchase or receive aggregated user information that helps us learn more about our customers and users of our Website. We may also share and receive information from fraud prevention companies to help avoid fraud and abuse related to our Website and purchases of our products.

 

Third-Party Use of Cookies and Other Tracking Technologies

Some content or applications, including advertisements, are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers, such as Google Ads, or Google Customer Match, and Bing Ads. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our website. The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites and other online services. How We Use Your Information

Do Not Sell or Share My Personal Information

We may use the information we have collected from you to enable us to display advertisements to our advertisers’ target audiences. Even though we do not disclose your Personal Information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

 

As part of this Privacy Policy, we “publicly commit” to not re-identify Non-Personally Identifiable Information, deidentified data, pseudonymous data, or any other concern. We also take measures to ensure that Non-Personally Identifiable Information, which we have de-identified, cannot be associated with an individual person. We expect service providers and third parties with whom we do business to similarly refrain from re-identifying Non-Personally Identifiable Information, to the extent required by California law, and by the law of the states in which they are based.

 

Disclosure of Your Information

 

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

  • To our subsidiaries and affiliates.

  • To our CDN and WAF providers in serving access to our Website.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of K-1’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by K-1 about our Website users is among the assets transferred.

  • Do Not Sell or Share My Personal Information
  • To fulfill the purpose for which you provide it. For example, if you give us an email address to use the “email a friend” feature of our Website, we will transmit the contents of that email and your email address to the recipients.

  • Internet or other electronic network activity information, including, but not limited to, K-1’s browsing history, search history, and information regarding a consumer’s interaction with K-1’s Website, or advertisements (whether on or off K-1’s Website).
  • Inferences drawn from any other category of Personal Information identified above, to create a profile about a consumer’s preferences as to K-1’s products.
  • Communications with K-1 Customer Service representatives.

 

Notice of Right to Opt Out; Do Not Sell or Share My Personal Information

We strive to provide you with choices regarding the Personal Information you provide to us, consistent with the applicable laws in your jurisdiction. Accordingly, we have provided this unified Notice of Right to Opt Out pursuant to the California Consumer Privacy Act of 2018 as amended, and similar laws of other states. However, even if you do not live in California or another jurisdiction with heightened rules, we will accept the same requests made by you or on your behalf.

  • Know. You may request a copy of your Personal Information in our possession.
  • Delete. You may request that we delete your Personal Information in our possession.
  • Correct. You may request to have your Personal Information corrected, to the extent it is inaccurate.
  • Opt-Out of Sharing. You may opt out of our sharing Personal Information with other parties, to the extent it is not required for an existing order or transaction or other permitted purpose, consistent with applicable law. You may also opt out of collection, which will prevent the sharing of this information, by electing not to allow cookies at our link shown on the consent bar and dialog from CookieYes.
  • Tracking Technologies and Advertising. Tracking technologies include things like cookies, and web beacons
    • You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent.     • Beacons are transmitted to all customers using commercial email platforms, in the form of a tiny image that registers as a counter or tracker, for the specific email. Accessing and Correcting Your Information

Requests to delete may be conditioned on receiving confirmation that the request is legitimate, and to avoid unauthorized access or deletion of Personal Information. Requests to delete are processed within forty (45) days, from our receipt of confirmation that the request is legitimate. We reserve the right to extend this period as necessary and if consistent with applicable law. We cannot delete your Personal Information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

We do not intentionally collect Sensitive Personal Information, except as follows:

  • Credit card payment information for processing orders.
  • Information provided to K-1’s Customer Service representatives by customers.

 

How We Use Sensitive Personal Information

We only use Sensitive Personal Information for purposes that are “reasonably necessary and proportionate” to the provisions of goods or services our Customers request, provide customer service requested by our Customers, and otherwise prevent fraud and illegal activities, as well as complying with legal obligations. Our Customers have evidenced their consent to these uses by providing Sensitive Personal Information.

 

Your Choices

For most Customers, there is no need or mechanism to “opt out” of our use of Sensitive Personal Information, as we only use information for purposes which our Customers provided it to us or to our service providers. However:

  • If you have provided Sensitive Personal Information to our K-1 Customer Service representatives, or believe we have otherwise received Sensitive Personal Information, and nonetheless would like to inform us of your preference that we not retain or share your Sensitive Personal Information with Third Parties, you may send us an email stating your belief that we have Sensitive Personal Information (with a reasonable description, such as with a reference to the date and time of an email, or the category and type of information if not listed above), and request that we delete or limit the use. Verification of Your Request: For your security, we may need to verify your identity before processing your request.

 

Response Time: We will confirm receipt of your request within 10 business days and will respond fully within 45 calendar days, as required by the California Consumer Privacy Act of 2018 as amended, or other applicable law.

 

Right of Appeal: If we deny or refuse to act within 45 calendar days, residents of Colorado, Connecticut, Delaware, Montana, Oregon, Florida, Indiana, Tennessee, Texas, Virginia, Iowa and Utah may have the right to appeal within our denial, with proof of their residency in the applicable state. Code Ann. §§ 59.1-575  to 59.1-584) provide (now or in the future) their state residents with rights to:

  • Access and delete certain personal information.
  • Correct inaccuracies in their personal information, taking into account the information’s nature processing purpose (excluding Iowa and Utah).
  • Data portability.

    • sales; or

The exact scope of these rights vary by state, and the laws of these states may only apply to K-1 if certain thresholds are met (such as in terms of number of users from a state, or a volume of transactions. By this privacy policy, K-1 does not voluntarily consent to the jurisdiction of the above states, and reserves the right to determine whether such thresholds have been met, prior to accepting and processing any requests (other than under the California Consumer Privacy Act of 2018, as amended).
